Multinational confectionery company, Mondelez, is currently threatening legal action against a London-based vegan snack maker over the colour of one of its fruit bars. The company says that the Primal Pantry's cocoa bar "exploits" and infringes the trademark of its Milka chocolate range and its lawyers and demanding the cessation of the lilac packaging, or to face a £5,200 penalty each time the trademark is infringed. However, the vegan brand's managing director denies hurting the trademark and said the range of the bars' colours vary so that "they have good differentiation on a shelf together", said Adam Draper. Do you think a company should be able to trademark a colour?
