Is the Highway Code(the rules of the road) the law.I think its not

Now up untill this week i thought the highway code was law but on Wednesday my husband was doing a 3 point turn in his car on a quite clear road 20 meters from a junction.During the last part of the manover he was in the middle of the road when a car came to the junction turned into the road tried to undertake my husband and hit his car causing £1500 worth of damage.The driver of the car admitted she had seen my husband doing this manuver.Our insurance company says that it is my husbands fault for being in the middle of the road but the highway code says you should not undertake(unless the car on the right is turning right or on a roundabout) and should stop if there is an obstical in the road. So we have to pay our policy exess and lose one chance on our protected no claims(we have 3)and pay for the damage to the ladies car and she will not have to pay her excess.Our kids who have passed thier tests 2 and 4 yrs ago say that thier instructor taught them that when they were doing a 3 point turn not to panic if another car approached as that car would have to stop.What do you think?

I am sure the woman who went into your car, is to blame she should have waited until he had finnished the manouvre it was obvious to see what he was doing and she was obviously not wanting to wait

If the woman saw your husband doing the three point turn she should have stopped until he had completed the manoeuvre.

Afraid I can't drive so don't know much about the various manoeuvres, but it sounds as if the other car should have stopped and I do hope your husband manages to get it sorted out with the insurance company.

I have not long passed my test and when I was learning the instructor used to tell me to take my time when doing a 3 point turn and not to worry about approaching traffic.

insurance companys are always happy to take your money but never give anythiong back. i have a had a bad experience with them.

i think this is ridiculous your hubbie was doing a difficult manouver so the other car should of stopped and waited. What is the point of the highway code if no one follows it x
